Terms of service.
These terms govern use of the WynterIX website. You may read, share, and link to it. You may not misuse it, copy it wholesale, or attack it. Content is informational and carries no warranty. Client work is governed by separate signed agreements, not these terms. The law of the state where WynterIX LLC is organized applies.
Effective date: September 23, 2026. These terms are an agreement between you and WynterIX LLC (WynterIX, we, or us) about your use of this website. By using the site you accept them. If you do not accept them, do not use the site.
These terms cover the website, not client work.
These are website terms only. Any engagement with WynterIX, including a project, a retainer, or an Exclusive Market Partnership, is governed by a separate written agreement signed by both sides. If that agreement and these terms conflict, the signed agreement controls.
Nothing on the site is an offer that you can accept by submitting a form. Prices, terms, and package contents published on the site describe how we work, and they become binding only when they appear in a signed agreement.
You may use the site to read, learn, and apply.
You may browse the site, read and print pages for your own use, share links to any page, and submit the application or market availability forms. You must be old enough to form a binding contract where you live, and if you apply for a business, you confirm you are allowed to act for it.
Some uses of the site are not allowed.
- Submitting false, misleading, or someone else's information through the forms.
- Sending spam, solicitations, or automated submissions through the forms.
- Probing, scanning, or testing the site for vulnerabilities, or trying to get around the bot protection or rate limits.
- Interfering with the site, its hosting, or other visitors, including by overloading it with requests.
- Scraping or copying the site in bulk, including to train or feed an automated system, beyond what ordinary search indexing does.
- Using the site for anything unlawful, or to harm WynterIX or anyone else.
We may block access from any person, network, or system that breaks these rules, without notice.
We own what is on this site.
The text, visuals, design, code, and structure of this site belong to WynterIX LLC or are used with permission. The names WynterIX, FROST, GLACIER, and PERMAFROST, and the tagline Cold tech for a cold world, identify our services and may not be used in a way that suggests we endorse you or your product.
You may quote short excerpts with clear attribution to WynterIX and a link to the source page. You may not republish whole pages or articles, present our content as your own, or change it and attribute the result to us. Other companies and products named on the site, such as Google, Cloudflare, or Search Console, belong to their owners and are named for description only.
What you send us stays yours.
You keep ownership of anything you submit through the forms. You give us permission to use it to evaluate your request, reply, and prepare a proposal. You confirm that what you send is accurate and that you have the right to share it.
Submitting a form does not create a confidential relationship or an engagement. Do not send trade secrets or confidential material until a signed agreement covers it. How we handle personal information is set out in our privacy policy.
Informational content comes with no warranties.
Articles, the glossary, the FAQ, and service descriptions are general information. They are accurate to the best of our knowledge when written, but search engines and AI answer engines change often, and what was true when a page was published may not be true now. Nothing on the site is legal, tax, financial, or other professional advice for your situation.
The site and its content are provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not promise the site will be uninterrupted, error-free, or free of harmful components.
Our liability for the site is limited.
To the fullest extent the law allows, WynterIX is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site or your reliance on its content. This applies whatever the legal theory and even if we were told such damages were possible.
The site is free to use. Our total liability for all claims arising from it is limited to the smallest amount the law permits. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
You are responsible for how you use the site.
If your breach of these terms, or your misuse of the site, leads to a claim against WynterIX, you agree to cover the reasonable costs of that claim, including legal fees. This does not apply to claims caused by our own conduct.
The site relies on a few outside services.
The site is hosted and protected by Cloudflare, and form submissions are delivered by Resend. The site contains no links to outside websites. We may change, suspend, or remove any page or feature at any time, and we are not responsible for downtime caused by those providers or by events outside our control.
The law of our home state governs these terms.
These terms are governed by the laws of the state in which WynterIX LLC is organized, without regard to its conflict of law rules. Any dispute arising from the site or these terms is brought in the state or federal courts located in that state, and you consent to their jurisdiction.
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, we have not waived it. You may not transfer your rights under these terms, and we may transfer ours to a successor business.
We may change these terms.
When we change these terms, we update the effective date at the top of this page. Changes apply from that date. If you keep using the site after a change, you accept the new terms.
